Terms & Conditions
These static Terms outline registration, bidding, payment, pickup, and default rules for Caspert auctions. Review sale-specific addenda published with each auction for additional conditions.
Registration & eligibility
- - All bidders must register, verify identity, and agree to these Terms prior to bidding. Caspert reserves the right to deny or revoke bidding privileges at its discretion.
- - Business bidders must provide resale certificates or tax documentation when applicable.
- - Bidders are responsible for maintaining current contact and payment details.
Bidding & increments
- - All bids are binding and cannot be retracted. Bid increments are shown on each lot; auctioneer may adjust increments during the sale.
- - Max bids may be placed; the system will auto-advance your bid to maintain winning position up to your max.
- - Tie bids favor the earliest bid received.
Buyer’s premium, taxes, and fees
- - A buyer’s premium (see lot or sale terms) is added to the hammer price of each lot.
- - Sales tax is applied where required; provide valid exemption certificates prior to invoicing.
- - Additional fees may include rigging, handling, late pickup, and storage where applicable.
Payment terms
- - Invoices are issued after auction close. Payment is due within the stated timeframe on the invoice.
- - Accepted methods: wire transfer, certified funds, and approved credit cards where noted. Surcharges may apply.
- - Non-payment may result in forfeiture of bids, suspension of bidding privileges, and pursuit of remedies including resale of items at bidder’s expense.
Inspection & condition
- - All items sell “AS IS, WHERE IS, WITH ALL FAULTS.” No warranties, express or implied, are provided.
- - Inspection is strongly encouraged. Descriptions, photos, and measurements are provided as a guide only.
- - Failure to inspect does not relieve bidder of responsibility or obligations after purchase.
Removal & pickup
- - Buyer is responsible for removal, rigging, shipping, and compliance with site safety rules.
- - Removal must occur within posted pickup windows. Late pickups may incur storage/handling fees or forfeiture.
- - Bring proper equipment and personnel; some lots may require professional riggers. Insurance may be required.
Risk of loss & title
- - Risk of loss passes to buyer upon award of bid. Title transfers upon full payment and removal.
- - Auctioneer may resell or dispose of items if payment or removal deadlines are missed, without refund of deposits or premiums.
Defaults & remedies
- - If buyer defaults on payment or removal, Caspert may cancel the sale, retain deposits, resell items, and seek damages.
- - Buyer is liable for deficiency, storage, handling, legal fees, and other costs arising from default.
Governing law & venue
- - These Terms are governed by the laws of the applicable jurisdiction stated in the auction listing. Venue for disputes shall be in that jurisdiction.
- - Participation constitutes acceptance of these Terms and any sale-specific conditions published with the auction.
Acknowledgement
By participating you confirm you have read and agree to these Terms & Conditions and any auction-specific terms. All bids are final and binding. If you have questions, contact support@caspert.com before bidding.
